On Tuesday’s Will Cain Show, Sen. Rand Paul (R-KY) argued that the Trump administration’s military strike against a Venezuelan drug-trafficking boat lacked constitutional authority. Paul, a longtime libertarian voice, warned that if such actions became “policy,” America could end up blowing up ships “off of Miami” without due process.

“The reason we board them before we blow the crap out of them is some of them don’t have drugs,” Paul said. He compared it to busting a fentanyl house in your neighborhood: “Do you go over there and just kill them or burn them? No, you go to a judge and you get a warrant.”

But Cain pushed back: “They’ve been designated a foreign terrorist organization and they’re importing a chemical that’s killing tens of thousands of Americans.”

Paul doubled down: “Not by Congress—not by Congress, by the president. That’s not constitutional. Under the Constitution, Congress must declare war.”
